1. Introduction and Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the website and services provided by Palvam Projects Private Limited(hereinafter referred to as"Palvam Projects," "We," "Us," or "Our"),operating under the brand name Alchemy Constructions ("Alchemy"). By accessing or using our website, you agree to these Terms. All contracts for services, invoicing, and legal obligations are entered into by and with the legal entity, Palvam Projects Private Limited.

2. Services Offered by Alchemy Constructions and Governing Documents

Alchemy Constructions offers direct Design-and-Build Construction Services in Hyderabad.

  • Core Services Provided: Architectural & Structural Design, Statutory Approvals Facilitation, Project Planning & Management, Material Sourcing & Procurement, End-to-End Construction Execution, and Post-Construction Structural Warranty.
  • Governing Agreement: All project-specific commitments (scope, timelines, payments, and guarantees) are exclusively governed by a separate, formal, written "Construction Agreement" executed between You and Palvam Projects Pvt Ltd. The Construction Agreement prevails over these Website Terms in case of conflict.
  • Exclusions: Standard services exclude specialized work like rock cutting, blasting, dewatering, solar fencing, or landscaping. These are charged extra as detailed in the Construction Agreement.

3. User Engagement and Responsibilities

You acknowledge that, under the Construction Agreement, you are responsible for:

  • Obtaining all requisite official Municipal Permissions.
  • Providing a clear site, including the dismantling and removal of any existing structures.
  • Providing an uninterrupted supply of potable water and electrical powerrequired for all site operations at your own cost.
  • Fulfilling obligations, including making timely payments as per the schedule outlined in the Construction Agreement.

4. Financial Terms and Material Price Fluctuation

  • Quotes are Non-Binding: Initial estimates are preliminary and not legally binding until formally executed in a Construction Agreement.
  • Material Price Fluctuation: Pricing is based on material thresholds (e.g., Cement, Sand, Steel). Any price increase beyond these rates due to market fluctuations shall be compensated by the Owner as detailed in the Construction Agreement.
  • Contractor-Installed, Owner-Purchased Materials: If the Owner purchases materials not specified for the Contractor to install, a separate service fee, calculated at ten percent (10%) of the total purchase value, shall be payable.
  • Owner-Installed Items: If the Client purchases and installs any item, whether specified or not, a separate service fee of five percent (5%) of the item's value will be added to the project cost for coordination/oversight.

5. Project Timelines and Delays

  • Project Duration Benchmark: Estimated construction timeline benchmark: The Ground Floor requires a minimum of four and a half (4.5) months for completion, and an additional one and a half (1.5) months is typically required for each subsequent upper floor.
  • Owner-Induced Delay: We are not responsible for timeline extensions resulting from the Owner's failure to provide timely approvals, information, or payments. Additional costs due to such delays shall be borne by the Owner.
  • Contractor-Induced Delay: Liability for delays solely attributable to the Contractor is specified in the Construction Agreement (typically involving a pro-rata penalty).

6. Warranties and Guarantees (Specific Reference)

All warranties are fully detailed and controlled by the Construction Agreement.

  • Structural Warranty: The Construction Agreement specifies a Ten (10) year warranty on the building structure against defects.
  • Warranty Conditions: This warranty is subject to the Owner having paid the entire Contract Price in full. It does not cover natural wear and tear, cosmetic issues (e.g., hairline cracks), or damage caused by misuse or lack of maintenance.

7. Intellectual Property Rights

  • Ownership: All website content, logos, and proprietary construction methodologies are the exclusive property of Palvam Projects Pvt Ltd.
  • Project Designs: All architectural, structural, and engineering designs and plans created by Alchemy Constructions remain its intellectual property.

8. Disclaimers, Indemnity, and Limitation of Liability

A. Key Assumptions and Exclusions

  • Soil Test Report (STR): The Owner can provide a certified STR. Alternatively, Palvam Projects Pvt Ltd will facilitate and provide the STR at a nominal cost.
  • Foundation Depth/SBC: The price assumes a foundation depth up to 6 feet 6 inches (2 meters) and a minimum Soil Bearing Capacity (SBC) of 30 Tons/m²Costs for excavation or foundation work beyond these assumptions will be borne by the Owner.

B. Limitation of Liability

We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website or preliminary services.

9. Governing Law and Dispute Resolution

  • Governing Law and Jurisdiction: These Terms are governed by the laws of India. The courts located in Hyderabad, Telangana, shall have exclusive jurisdiction.
  • Dispute Resolution: Disputes shall first be settled amicably.If unresolved, the dispute shall be settled by binding arbitration in Hyderabad, Telanganain accordance with the Arbitration and Conciliation Act, 1996.
  • Grievance: For any formal grievance, please refer to the contact details of our Grievance Officer as specified in our Privacy Policy.

10. Referral Program

Alchemy Constructions may offer a referral program.

  • Eligibility:A referrel is eligible for a benefit upon the successful conversion of the referral (e.g., completion of the ground floor slab).
  • Benefits for Referrer: Cashback is based on the Project Value:

  • Reservation of Rights: : Palvam Projects Pvt Ltd reserves the right to modify, suspend, or discontinue the referral program without prior notice.

11. Miscellaneous Provisions

Modification:We reserve the right to modify these Terms at any time. Your continued use constitutes acceptance of the new Terms.
